The Finnish Market Court gives ruling on matter between Gasum and Finnish Energy Authority

On 13 May 2026, the Finnish Market Court has ruled on a matter between Gasum and the Finnish Energy Authority concerning unbundling obligations under the Natural Gas Market Act.

On 17 July 2020, the Energy Authority submitted to the Market Court that the court impose a penalty fee on Gasum for non-compliance with the unbundling provisions of the Finnish Natural Gas Market Act in conjunction with Gasum’s demerger concerning the natural gas transmission network operations.

On 7 November 2022 the Market Court reversed the decisions issued by the Energy Authority concerning Gasum’s financial statements. In addition, the Market Court dismissed the Energy Authority’s proposal concerning a penalty fee. The Energy Authority appealed the Market Court’s ruling to the Supreme Administrative Court.

By a ruling given on 28 March 2024, the Supreme Administrative Court reversed the Market Court’s decision and returned the penalty fee proposal to the Market Court for reconsideration.

According to the decision given on 13 May 2026, the Finnish Market Court has decided that Gasum is liable to pay a EUR 17 million penalty fee for non-compliance with the unbundling provisions of the Finnish Natural Gas Market Act. Gasum is disappointed with the decision. The decision is not legally binding and can be appealed to the Supreme Administrative Court. Gasum is currently carefully reviewing the decision and considering possible next steps in the matter.
